As of 7/30/09 ClearPoint Funding requires compliance with the Mortgage Disclosure Improvement Act (MDIA) that revises the disclosure requirements for mortgage loans under Regulation Z, which implements the Truth-in-Lending ACT (TILA). ClearPoint Funding must disclose directly to the borrower prior to any fees other than credit being charged. You must wait until the 4th business day after ClearPoint Funding sends the disclosure package or upon verified receipt and acknowledgement by the borrower to order the appraisal. This means:
- You will need to submit your loan to ClearPoint Funding for disclosure purposes.
- We will continue to process purchase files through underwriting, but refinance files will be put on hold until the appraisal has been received.
- The four business day waiting period begins when ClearPoint Funding sends you an email alert that the loan has been disclosed.
